By accessing or using RedCurate ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We may update these Terms from time to time. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

2. Description of Service

RedCurate provides AI-powered Reddit digest services. We aggregate and summarize publicly available Reddit content based on your preferences and deliver it to your email.

The Service uses artificial intelligence to analyze, summarize, and curate Reddit content. AI-generated summaries may not perfectly represent the original content. We encourage users to visit original Reddit posts for complete information.

3. Account Terms

• You must provide a valid email address to create an account
• You must be at least 13 years old to use this Service
• You are responsible for maintaining the security of your account
• You are responsible for all activities that occur under your account
• One person may not maintain more than one account
• You must provide accurate and complete information when creating your account

4. Subscription and Payment

RedCurate offers both free and premium subscription plans.

4.1 Free Plan

The free plan provides limited access to our Service at no cost. Free plan features and limitations may change at any time without notice.

4.2 Premium Subscription

Premium features require a paid subscription. By subscribing to a premium plan, you agree to pay the applicable fees. Payments are processed by our third-party payment processor, Polar.sh.

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• Subscription fees are non-refundable except as required by law
• We may change subscription pricing with 30 days advance notice
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period

4.3 Payment Processing

All payments are processed by Polar.sh, a third-party payment processor. By providing payment information, you authorize Polar.sh to charge your payment method. We do not store your complete payment card information on our servers.

5. Refund Policy

Our refund policy is as follows:

• No prorated refunds: If you cancel your subscription, you will continue to have access until the end of your current billing period. No partial or prorated refunds will be issued.
• Processing fees are non-refundable: Third-party payment processing fees charged by Polar.sh are non-refundable.
• Discretionary refunds: Any refunds beyond the above policy are provided at our sole discretion.
• Dispute resolution: If you believe you are entitled to a refund, please contact us at hello@redcurate.com before initiating a payment dispute.

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Resell, redistribute, or commercially exploit digest content without permission
• Use automated means (bots, scrapers) to access the Service beyond normal usage
• Interfere with or disrupt the Service or servers connected to the Service
• Transmit any viruses, malware, or other harmful code
• Violate Reddit's terms of service or any third-party terms
• Use the Service to harass, abuse, or harm others
• Attempt to identify anonymous Reddit users through our Service

7. Intellectual Property

7.1 Reddit Content

Reddit content summarized by RedCurate remains the property of its original creators and Reddit, Inc. We provide AI-generated summaries of publicly available content as a service. We do not claim ownership of any Reddit content. Original Reddit posts are linked in our digests so you can access the source material.

7.2 Our Content

The RedCurate name, logo, website design, and original content (excluding Reddit content) are owned by RedCurate and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content without written permission.

7.3 User Content

Any preferences, keywords, or other content you provide to the Service remains your property. By providing such content, you grant us a license to use it solely for the purpose of providing the Service.

You agree to indemnify, defend, and hold harmless RedCurate and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit or transmit through the Service
• Your violation of any applicable laws or regulations

11. Termination

11.1 Termination by You

You may cancel your account at any time through your account settings or by contacting us. Upon cancellation, your right to use the Service will cease immediately, but your data may be retained for a reasonable period as described in our Privacy Policy.

11.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to: violation of these Terms, fraudulent or illegal activity, or non-payment of fees.

11.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to: intellectual property provisions, warranty disclaimers, limitation of liability, and indemnification.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Before filing any formal legal claim, you agree to first contact us at hello@redcurate.com and attempt to resolve the dispute informally for at least 30 days.

For any disputes not resolved informally, you agree that any legal action shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RedCurate regarding the Service and supersede all prior agreements and understandings.

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
